These terms cover our public website. Regulated services require their own agreement with the relevant Maubex entity. Your mandatory local rights remain protected.

01About these terms

These Terms & Conditions govern use of our public Maubex Capital websites, including maubexcapital.com and maubexcapital.co.za and their www subdomains, operated by Maverick Trading 1388 CC, trading as Maubex Capital (“Maubex”, “we”, “us”). Please read these terms before using the website. If you do not agree to them, you should stop using it. They apply only to the extent a binding agreement is formed under applicable law. They do not make browsing a subscription, create a client mandate or authorise us to transact on your behalf.

Our Privacy Policy explains how website and enquiry information is handled. It is a transparency notice; acceptance of these terms is not consent to marketing, optional tracking or other processing requiring a separate choice.

02Global reach and local availability

Maubex Capital has an international business focus. Website accessibility in a country does not mean that every product or service is offered, registered, licensed or suitable there. Availability depends on the relevant Maubex entity, its permissions, your location and status, and applicable laws.

The South African entity identified above is described on this site under FSCA FSP No. 53778, Category I & II. A South African authorisation does not itself constitute authorisation by a regulator in Mauritius, the EEA, the UK, Australia, California or another jurisdiction. Refer to our regulatory disclosures and the specific contracting entity’s documentation for the relevant service.

Nothing on the website is an offer or solicitation where that would be unlawful. Before providing a regulated service, the relevant entity must confirm eligibility, permissions and any required restrictions. We may decline or limit a service where necessary to comply with law, sanctions, regulatory requirements or documented risk controls.

03Information and investment risk

Public website content is general information about Maubex and its services. It is not a personalised investment recommendation, financial plan, tax opinion or legal advice, and does not consider your individual circumstances. Seek advice appropriate to your objectives, financial position and jurisdiction before making a decision.

Digital assets and related strategies can involve substantial risk, including loss of all invested capital. Prices and liquidity may change rapidly. Counterparty failure, cyber incidents, operational disruption, network congestion, smart-contract defects and changes in law can affect access, value or settlement. Blockchain transactions may be irreversible, and protections applicable to bank deposits or conventional investments may not apply.

Past results, illustrative examples, target returns and indicative timing are not guarantees of future performance or execution. References to venues, chains, technology or partners do not mean every facility is continuously available or that a third party endorses Maubex. A specific risk disclosure and service agreement must be considered before transacting.

04Enquiries and client agreements

A website enquiry, an “Open an account” link or a portal link does not by itself open an account, establish an advisory relationship, create a custody arrangement or accept an order. A client relationship requires the applicable onboarding, eligibility checks and agreement with the identified legal entity.

Separate client documents govern matters such as fees, mandates, order handling, execution, custody, settlement, cancellation and service-specific complaints. Those documents take priority over these website terms for the service they govern, subject always to mandatory law. These website terms do not amend an existing client agreement.

Do not send trading instructions, transfer assets or disclose wallet private keys, seed phrases or account passwords through a general website enquiry. Use the verified channel specified in your client agreement. A form confirmation that your email application has opened does not confirm that Maubex has received the message; you must send it from that application.

05Using the website responsibly

You may browse and use the website for lawful personal or business information purposes. If you contact us on behalf of an organisation, ensure you have authority to do so and provide information that is accurate to the best of your knowledge.

  • Do not use the website for fraud, unlawful promotions, impersonation or infringement of another person’s rights.
  • Do not introduce malicious code, attempt unauthorised access, evade access controls or intentionally disrupt the website or its infrastructure.
  • Do not collect personal information from the site for unlawful use or use automated requests in a way that materially impairs availability.
  • Do not misrepresent a relationship with Maubex, alter our disclosures or reproduce content in a misleading context.

These restrictions do not limit activities that applicable law expressly permits and does not allow us to prohibit by contract. You can report a suspected security issue through our published contact details.

06Content and intellectual property

The website contains material owned by Maubex or used from other rights holders, including text, design, software, names, marks and media. Rights remain with their respective owners. You may view the website and save or print reasonable extracts for lawful reference, keeping relevant attribution and notices.

Other reproduction, commercial distribution, modification or use of Maubex branding requires permission unless applicable law allows it. Third-party names or marks are used to identify their respective organisations and do not transfer rights or imply endorsement.

You retain rights in information you send us. Sending an enquiry permits us to handle it for the purposes described in our Privacy Policy; it does not give us an unrestricted licence to publish your personal information or confidential business materials.

07External links and third-party services

The website may link to other sites or use third-party delivery services. External sites and independently provided services have their own terms and privacy notices. Review those before providing information or entering a transaction.

We do not control independent sites’ content or availability. A link is not a guarantee of their accuracy or security. This does not remove any responsibility that the law places on Maubex for its own selection, integration or use of a provider.

08Website availability and updates

We aim to keep the website useful and accurate, but information may become outdated and access may be interrupted by maintenance, faults or events outside reasonable control. Confirm current service details with us before relying on them for a transaction.

We may correct or update content and make reasonable changes to the public website. Access may be restricted where reasonably necessary for security, unlawful use or a legal requirement. Where practicable and appropriate, we will explain a restriction. A website interruption does not itself cancel rights or obligations under an existing client agreement.

Changes to these terms will be published with a new revision date and appropriate notice of material changes. They apply prospectively, subject to any acceptance required by law. They do not retrospectively remove accrued rights or change a separate agreement without the process required for that agreement.

09Responsibility and liability

The public website is provided for information. Subject to mandatory law, we do not promise uninterrupted availability, error-free content or suitability for an individual investment decision. These qualifications do not permit misleading statements or remove a duty that the law places on us.

To the extent lawfully permitted, Maubex is not responsible for losses that were not reasonably foreseeable consequences of its breach of these website terms, or for losses caused by your unlawful misuse of the site. Responsibility for regulated services is addressed in the relevant client agreement and applicable law.

Nothing here excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nor does it limit non-excludable consumer guarantees, remedies, data-protection rights or regulatory obligations. If applicable law requires a higher standard of responsibility, that standard applies.

10Your mandatory local rights

These terms are intended to operate alongside mandatory protections in the jurisdictions where they apply. No statement about website use waives a non-waivable right.

  • South Africa: applicable consumer, electronic-transactions, financial-services and POPIA rights and remedies remain available.
  • EEA and United Kingdom: applicable consumer protections, unfair-term rules, data-protection rights and rights to use a competent local court are preserved.
  • Australia: nothing excludes applicable rights under the Australian Consumer Law, the Australian Securities and Investments Commission Act or the Privacy Act. Non-excludable guarantees and remedies apply where the relevant law covers the product or service; financial products and services can be governed by different rules from ordinary consumer goods.
  • California and other US states: applicable consumer and privacy rights remain available. These website terms do not impose mandatory arbitration or a class-action waiver.
  • Mauritius and other jurisdictions: applicable consumer, financial-services and data-protection protections continue to apply, including Mauritius’s Data Protection Act where relevant.

Listing a jurisdiction recognises potential legal protections; it does not represent that Maubex is licensed to provide every service there.

11Complaints, law and disputes

For a website question or complaint, contact jeanluc@maubex.com with a description and your preferred reply details. For a regulated-service complaint, use the procedure in your client documents or ask us for the appropriate complaints contact and external dispute-resolution route. Privacy complaints and regulator contacts are set out in the Privacy Policy.

Subject to mandatory applicable law, these website terms are governed by South African law and disputes may be brought before a competent South African court on a non-exclusive basis. This choice does not deprive you of protections that cannot be excluded under the law of your habitual residence or another applicable jurisdiction, or prevent proceedings in another court that has jurisdiction.

You are not required by these terms to exhaust an internal complaint process before using a regulator, ombud, tribunal or court where the law permits you to do so.

12General provisions

If a provision is unlawful or unenforceable, it applies only to the extent lawfully permitted or is severed where the law allows, without removing the remaining provisions that can operate fairly and independently. A delay in exercising a right is not automatically a waiver of it.

These terms concern the public website only. A separate written agreement, applicable service terms and mandatory law continue to govern any other relationship. You may save or print this page for your records.
